ADVICE WHEN EXERCISING
When taking part on any physical activities, please consider the following:
- RISK ASSESS YOUR AREA: Make sure that the area is clear and that you have enough space to move freely, clear of possible obstructions. Make sure that your space is at a suitable temperature and well lit.
- EXERCISE CAUTION: Stop if you feel dizzy, disorientated, very thirsty, a headache, racing pulse, palpitations, unusual aches or pains.
- PRE-EXISTING HEALTH CONDITION: If you have a pre-existing condition (e.g. Heart condition, back injury, diabetes, respiratory disease, pregnant etc) please consider whether a selected programme is suitable for you. If you have any doubt, seek medical advice and avoid taking part until you are reassured.
- IN CASE OF EMERGENCY: Keep your phone nearby, stop immediately and seek medical advice.

CANCELLATION AND REFUND POLICY
You comprehend that upon commencing a Transaction you are entering into a legally binding and enforceable contract with Mr Motivator and team to purchase the services and shall pay the Subscription Fee through the Issuing Bank to us using our Payment Facility.
1. Subscription Fees:
1.1 You shall pay for all subscription fees, and hereby authorises Mr Motivator (and its payment processors) to debit your bank account or charge your credit card, as accepted by you during signing off the subscription and billing terms.
1.2 You agree that all subscriptions are recurring and will renew automatically.
1.3 You will be solely responsible for paying and remitting to the appropriate tax authorities all applicable taxes (withholding tax, sales tax, services tax, value-added tax (VAT), goods and services tax (GST), etc.) or duties imposed by any government.
1.4 If we do not receive payment from your credit card or if your credit card expires or is rejected, we shall block your Licence and you agree to pay all the amounts due upon demand. Following any such non-payment, we may require you to provide a second valid card before continuing to use the Licence.
1.5 We reserve the right to take all steps necessary to collect amounts due from you, including but not limited to legal action and or using third party collection agencies.
2. Cancellation:
2.1 You agree that all subscription fees are charged automatically on a recurring basis until you cancel the subscription (both month-to-month or annual plans).
2.2 You may cancel the subscription by logging into your Account and clicking settings and choosing the “Change” or “Cancel” options under subscription and billing.
2.3 A confirmation email receipt is sent to you with the expiration date of the subscription. Please keep in mind that you are solely responsible for properly cancelling your account.
3. Refund:
3.1 The Licence is billed in advance on a month-on-month or annual basis and is non-refundable.
3.2 We do not offer prorated refunds for cancelled subscription plans.
3.3 There will be no refund or credits for partial usage of Licence during a month or refund for months unused with an active Licence.
3.4. All subscription plans, both month-to-month or annual plans are recurring and will automatically renew after the end of each paid subscription period unless you cancel the subscription and the subscription fee once paid will not be refunded.
4. Third Party Charges:
4.1 You shall directly pay the fees and charges for all third party vendors whose services you use in connection with availing services from our platform (e.g., internet access provider).
4.2 In addition to any fees charged by us, we reserve the right to charge you for any regulatory or governmental fees, contributions or other charges that are legally required or assessed.

6. Trademarks
6.1 The Motivation club logo and design are Mr Motivator trademarks and may not be used without prior written permission from Mr Motivator.
7. Limitation of liability
7.1 It is agreed and acknowledged by you that:
(a) the content provided on the Site is intended as general information only;
(b) the Site has not been developed to meet your individual requirements;
(c) the Site does not provide legal or other professional advice on which you may rely;
(d) the Site may from time to time be wholly or partially unavailable, inaccessible, or subject to interruption, and we do not guarantee their availability.
7.2 We will not in any circumstances be liable to you or to any third party, for any claim (whether in contract, tort (including negligence), breach of statutory duty or otherwise) arising under these Terms of Use or in connection with your using the Site, for any loss, damage, cost, or expense and including any:
(a) loss of profits, sales, business, or revenue;
(b) business interruption;
(c) loss of anticipated savings;
(d) loss or corruption of data or information;
(e) malware, viruses, worms, or like software that may damage your computer systems or equipment or other property due to your having accessed the Site;
(f) loss of business opportunity, goodwill or reputation; or
(g) any special, indirect, incidental or consequential loss, damage, costs, or expense of any kind or nature, even if foreseeable or if we have been advised of their possibility.
7.3 You acknowledge that the risk allocation provided for in this clause is reflected in the rights, benefits and obligations under the Terms of Use. You also recognise the general nature of the Site and our lack of control of how and for what purposes the contents of the Site are used by you.
7.4 You indemnify us (on demand) against and will be responsible for each loss, liability, or cost incurred as a result of any claim by any person against us which arises as a result of you using the Site.
7.5 The obligations and liabilities connected with Taking or having Taken the Course are dealt with in the User Licence. For the avoidance of doubt, in the event of any conflict in relation to the Taking of the Course, the individual User Licence will take precedence.
8. Events outside our control
8.1 Further to the exclusions set out in the Terms of Use, it is agreed that we will not be liable or responsible for any failure to perform, or delay in performing, any of our obligations under the Terms of Use which is caused by an Event Outside Our Control.
8.2 An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation failure of public or private telecommunications networks.
8.3 If an Event Outside Our Control takes place that affects the performance of our obligations under the Terms of Use:
(a) our obligations under the Terms of Use will be suspended, and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control; and
(b) we will use our reasonable endeavours to find a solution by which our obligations under the Terms of Use may be performed despite the Event Outside Our Control.
9. Viruses
9.1 We do not guarantee that the Site will be secure or free from malware, viruses, worms, or like software that may damage your computer systems. You should use your own protection software in respect of the same.
9.2 You are responsible for configuring your information technology, computer programs and platform in order to access the Site.
10. Linking to the site
10.1 You may link to our home page, provided you do so in a way that is fair and does not damage our reputation or take advantage of it.
10.2 The Site must not be framed on any other website, nor may you create a link to any part of the Site other than the home page.

12. Applicable law

12.2 Each of the conditions of this Licence operates separately. If any court or competent authority decides that any of them are unlawful or unenforceable, the remaining conditions will remain in full force and effect.
13. Miscellaneous
13.1 The above Terms and Conditions and the Privacy Policy shall bind all parties and constitute the entire agreement of the parties and prevail in any and all prior and existing contracts between us.
13.2 We reserve the right, at our own discretion, to modify or replace any part of these Terms and Policies. It is your responsibility to check the Policies and Terms & Conditions periodically for changes. Your continued use of Site or access to the Platform following the posting of any changes to the Policies or Terms & Conditions constitutes acceptance of those changes. We may also, in the future, offer new services and/or features through our Site/Platform. Such new features and/or services shall be subject to the updated/revised Policies and Terms & Conditions.
